The rules for using Wisp, in plain English. The short version: be decent, follow Discord's rules, and you can cancel any time.
1. About these terms
These terms are an agreement between you and [your full name or business name] ("we", "us"), who runs Wisp: the Discord bot, the website and the dashboard (together, "the Service"). By creating an account, adding the bot to a Discord server or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
You can contact us at [your contact email] or in our Discord server.
2. Who can use it
You must be at least 13 years old (Discord's own minimum age) and allowed to use Discord. If you're under 18, you need a parent or guardian's permission to buy a subscription. You must follow Discord's Terms of Service and Community Guidelines while using the Service.
3. Your account
You create an account by signing up with your Discord account. You're responsible for what happens under your account, so keep your Discord account secure. Tell us straight away if you think someone else is using it. You can download your data or delete your account at any time from your account page.
4. The Service
Wisp provides moderation, automation, community and utility features for Discord servers, set up through the dashboard. Only people who manage a server on Discord (or who that server allows) can change its settings.
If you add the bot to a server or set it up, you're responsible for how it's used there. That includes the messages it posts, the roles it gives, and the actions it takes because of your settings, such as deleting messages, timing out, kicking or banning members. Please check your settings carefully. You should also tell your server's members about the features you use (for example, that messages are checked by auto-moderation and that logs are kept).
5. Free trial
Each Discord server gets one free trial of 7 days, starting when the bot is first added to it. You don't need to give card details for the trial, and you won't be charged when it ends. When it ends, the bot pauses in that server until the server is covered by a subscription. Removing and re-adding the bot doesn't start a new trial.
6. Subscription and payment
Price. A subscription costs £2.99 a month (including any VAT that applies) and belongs to your account. One subscription covers every server you manage that you choose to use it in.
Billing. Payments are taken in advance each month by our payment provider, Stripe, until you cancel. If you subscribe from a server during its free trial, your first payment is taken when that trial ends.
Price changes. We'll tell you at least 30 days before any price change takes effect, and you can cancel before then.
Failed payments. If a payment fails, Stripe will try again. If it still can't be taken after a few days, the bot pauses in the servers your subscription covers until it's paid.
Fair use. There's no limit on the number of servers, but a subscription is for one person's own servers and the servers they help run. It isn't for reselling or sharing as a service to others.
7. Cancelling and refunds
You can cancel at any time from your account page ("Manage billing"). Your subscription then keeps working until the end of the month you've already paid for, and isn't renewed.
Your right to cancel. If you're a consumer in the UK, you normally have 14 days to cancel a contract for digital services. When you subscribe, you ask us to start the Service straight away. If you cancel within 14 days of your first payment, we'll refund that payment, less an amount for the time you've already used. After that, payments aren't refunded for part of a month, except where the law gives you a right to one, or where the Service has been seriously faulty.
8. Acceptable use
You must not use the Service to:
break the law or Discord's rules, or help anyone else to;
harass, threaten, impersonate or harm anyone, or send spam;
try to get into accounts, servers or data that aren't yours, or get around the Service's limits or payments;
attack, overload, scan for weaknesses in or reverse-engineer the Service (if you find a security problem, please tell us privately instead, and thank you);
resell or offer the Service to others without our written permission.
9. Your content
Anything you or your server's members create (settings, messages, custom commands and so on) stays yours. You let us store and process it only as needed to run the Service for you. You're responsible for making sure you have the right to use anything you put into the Service, such as images in embeds.
10. Changes to the Service
We're always improving Wisp, so features may change. If we remove a major feature you pay for, or make a change that's significantly worse for you, we'll let you know, and you can cancel and get a refund for any time you've paid for but not used.
11. Availability and support
We work hard to keep the Service running, but we can't promise it will always be available or free of errors. It depends on Discord and other providers, and sometimes we need to do maintenance. Support is given through our Discord server.
12. Suspension and ending
You can stop using the Service at any time by removing the bot and deleting your account. We may suspend or end your access, or the bot's access to a server, if you seriously or repeatedly break these terms, or if we have to by law. Where it's reasonable, we'll warn you first. If we end the Service for a reason that isn't your fault, we'll refund any time you've paid for but not used.
13. Our responsibility to you
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. It also doesn't affect your legal rights as a consumer.
Otherwise, we're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or not taking reasonable care. We're not responsible for loss that wasn't foreseeable. We're also not responsible for business losses (the Service is for personal and community use), or for things caused by Discord or by how a server's managers have set up the bot. Our total responsibility to you is limited to the amount you've paid us in the 12 months before the problem happened.
14. Discord
Wisp isn't made, endorsed or supported by Discord. Discord is a trademark of Discord Inc.
15. Changes to these terms
We may update these terms, for example when the law or the Service changes. If a change matters, we'll tell you on the website or by email at least 30 days before it takes effect, and ask you to agree again. If you don't agree, you can cancel before it takes effect.
16. Law
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
